Distance Sales Agreement — Mesafeli Satış Sözleşmesi

1. Subject

This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the product(s) that the Buyer ordered electronically through the Seller's website, in accordance with the Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

2. Product and payment

The type, quantity, size, color, sales price and shipping cost of the product(s) are as shown on the order and checkout pages. Payments are collected securely through licensed payment institutions. Prices are shown in the currency displayed at checkout.

3. Delivery

All products are made to order. Production takes 2–4 business days, after which the order is shipped with tracked international delivery. Estimated delivery times are shown at checkout. The Seller is responsible for the product until it is handed to the carrier; loss or damage during shipping is resolved by the Seller with a replacement or refund.

4. Right of withdrawal

Under Article 15/1-c of the Regulation on Distance Contracts, goods prepared in line with the consumer's wishes or personal needs (custom-made products) are exempt from the right of withdrawal. As all StarLux Textiles products are produced to the size, color and specifications chosen by the Buyer, change-of-mind returns cannot be accepted once production has started.

• Cancellation: orders can be cancelled free of charge within 6 hours of purchase, before production begins.
• Damaged or incorrect items: the Buyer may request a replacement or full refund within 14 days of delivery by contacting the Seller with photos of the item.

5. Complaints and disputes

The Buyer may submit any complaint to the Seller through the contact page; complaints are answered as soon as possible. For consumers residing in Türkiye, applications may be made to the Consumer Arbitration Committees and Consumer Courts of the Buyer's or Seller's place of residence within the monetary limits announced annually. For international consumers, the mandatory consumer protection rules of the country of residence remain applicable.

6. Effect

By placing an order and confirming payment on the website, the Buyer is deemed to have read, understood and accepted all terms of this agreement together with the preliminary information form (product features, total price, delivery and withdrawal conditions) presented at checkout.

İşbu sözleşme, Alıcı'nın Satıcı'ya ait internet sitesi üzerinden elektronik ortamda sipariş verdiği ürünlerin satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerini düzenler.

2. Ürün ve ödeme

Ürünlerin cinsi, miktarı, ölçüsü, rengi, satış bedeli ve kargo ücreti sipariş ve ödeme sayfalarında belirtildiği gibidir. Ödemeler lisanslı ödeme kuruluşları aracılığıyla güvenli şekilde tahsil edilir.

3. Teslimat

Tüm ürünler siparişe özel üretilir. Üretim süresi 2–4 iş günü olup ürünler takipli kargo ile gönderilir. Tahmini teslimat süreleri ödeme sayfasında gösterilir. Kargoda oluşan hasar veya kayıplarda Satıcı ürünü yeniden gönderir veya bedel iadesi yapar.

4. Cayma hakkı

Mesafeli Sözleşmeler Yönetmeliği'nin 15/1-c maddesi uyarınca, tüketicinin istekleri veya kişisel ihtiyaçları doğrultusunda hazırlanan mallarda (kişiye özel üretim) cayma hakkı kullanılamaz. StarLux Textiles ürünlerinin tamamı Alıcı'nın seçtiği ölçü ve renge göre üretildiğinden, üretim başladıktan sonra fikir değişikliğine bağlı iade kabul edilememektedir.

• İptal: Siparişler, üretim başlamadan önce, satın alımdan itibaren 6 saat içinde ücretsiz iptal edilebilir.
• Hasarlı veya hatalı ürün: Alıcı, teslimattan itibaren 14 gün içinde fotoğraflarla birlikte Satıcı'ya başvurarak değişim veya tam iade talep edebilir.

5. Şikâyet ve uyuşmazlık

Alıcı, şikâyetlerini iletişim sayfası üzerinden Satıcı'ya iletebilir. Türkiye'de ikamet eden tüketiciler, her yıl ilan edilen parasal sınırlar dahilinde Tüketici Hakem Heyetlerine ve Tüketici Mahkemelerine başvurabilir.

6. Yürürlük

Alıcı, site üzerinden sipariş verip ödemeyi onayladığında, ödeme sayfasında sunulan ön bilgilendirme formu ile birlikte işbu sözleşmenin tüm koşullarını okuduğunu, anladığını ve kabul ettiğini beyan etmiş sayılır.
